1. ROLE OF THIS DISCLAIMER

This Master Disclaimer is incorporated into and forms a legally binding part of the KAMTOUR Terms of Use (“Terms”).

By accessing or using the Platform, you acknowledge, agree to, and are legally bound by this Disclaimer.

In the event of any conflict, the Terms shall control.

2. INFORMATIONAL PLATFORM ONLY (NO SERVICES / NO INTERMEDIATION)

KAMTOUR is a private, independent, non-governmental organization.

KAMTOUR does not imply any affiliation with, endorsement by, or association with any government authority.

KAMTOUR is not:
– A governmental authority or regulatory body
– An accreditation or certification organization
– An endorsement, rating, or recommendation entity

KAMTOUR does not provide any guarantee, assurance, or representation regarding the quality, safety, legality, or outcomes of any services, providers, or third parties, whether public or private.

KAMTOUR operates solely as a private, informational and directory-based platform.

KAMTOUR:
– Does not provide medical, legal, financial, or professional advice
– Does not arrange, coordinate, or facilitate services
– Does not act as an agent, broker, or intermediary
– Does not establish provider–patient or client relationships

Use of the Platform does not create any agency, fiduciary, or advisory relationship.

KAMTOUR does not assume, and expressly disclaims, any duty of care, professional standard, or obligation toward any user, patient, client, or third party.

No provider–patient, advisor–client, or similar professional relationship is created through use of the Platform.

3. THIRD-PARTY CONTENT AND INFORMATION

All listings, profiles, materials, and content on the Platform:

• Are provided by third parties
• May be incomplete, outdated, or inaccurate
• May change at any time without notice

KAMTOUR:

• Has no obligation to verify third-party information
• Does not guarantee accuracy, completeness, or reliability
• Assumes no responsibility or liability for any third-party content
• KAMTOUR may rely entirely on third-party submissions and undertakes no independent verification or ongoing monitoring.
• KAMTOUR has no obligation to update, correct, or maintain any content.
• KAMTOUR is an interactive computer service provider within the meaning of 47 U.S.C. §230 and does not create or develop third-party content.

4. KAMTOUR VERIFIED™ DESIGNATION

KAMTOUR Verified™ is defined in and governed exclusively by the KAMTOUR Verified™ Disclaimer, which is incorporated by reference.

KAMTOUR Verified™:

• Is a limited, proprietary (of KAMTOUR) designation based on submitted information
• Does not constitute certification, accreditation, endorsement, or verification of clinical, legal, or regulatory compliance
• Does not constitute medical or clinical advice or recommendation
• Does not involve independent investigation or ongoing monitoring
• Any governmental approval, certification, accredition or endorsement

Any interpretation of KAMTOUR Verified™ inconsistent with the Verified™ Disclaimer is expressly disclaimed.

5. NO RELIANCE

You expressly agree that:

• You will not rely solely on the Platform or any KAMTOUR designation
• You will conduct your own independent due diligence

This includes, without limitation:

• Verifying credentials, licensure, and qualifications
• Evaluating risks and appropriateness of services
• Seeking independent professional advice

Any reliance on the Platform or any KAMTOUR designation is solely at your own risk and is deemed unreasonable as a matter of law.

6. USER RESPONSIBILITY

You are solely responsible for all decisions, including but not limited to:

• Medical or healthcare decisions
• Travel or cross-border arrangements
• Financial commitments
• Selection of providers or services

KAMTOUR has no involvement in and no responsibility for such decisions or outcomes.

KAMTOUR does not participate in, influence, or review any user decision-making process.

7. ADVERTISING AND SPONSORED CONTENT

The Platform may include advertising, sponsored content, and paid promotional placements, including enhanced visibility or featured listings. Such placements are based on promotional arrangements and do not reflect quality, ranking, endorsement, or recommendation by KAMTOUR. KAMTOUR Verified™ status and any associated application or review fees are independent of advertising or promotional arrangements and do not confer preferential treatment or outcomes.The Platform may include advertising and sponsored content.

Advertisers are solely responsible for:

• Accuracy of claims
• Legal and regulatory compliance
• Advertising, sponsored content, or placements do not constitute endorsement

8. NO WARRANTIES

All Platform content and materials are provided:

“AS IS” and “AS AVAILABLE”

KAMTOUR expressly disclaims all warranties, including:

• Accuracy
• Completeness
• Reliability
• Fitness for a particular purpose
• Non-infringement

9. LIMITATION OF LIABILITY (STRUCTURALLY ALIGNED WITH TERMS)

To the maximum extent permitted by law, KAMTOUR shall have no liability whatsoever, whether in contract, tort, negligence, strict liability, or otherwise, for:

• Any third-party actions, omissions, or misconduct
• Any healthcare, business, travel, or service outcomes
• Any reliance on Platform content or designations
• Any indirect, incidental, consequential, or punitive damages
• Any any claims arising from negligence, reliance, or alleged failure to act

This limitation applies even if such damages are foreseeable or KAMTOUR has been advised of the possibility of such damages.

Your sole remedy is to discontinue use of the Platform.  Liability is further limited as set forth in the Terms of Use, including applicable liability caps.

10. THIRD-PARTY SERVICES AND LINKS

The Platform may include links to external services or websites.

KAMTOUR:

• Does not control or operate third-party services
• Does not endorse or assume responsibility for them
• Has no liability arising from third-party interactions

All engagement with third parties is at your own risk.

KAMTOUR does not monitor, supervise, or control third-party services or interactions.

11. UPDATES AND MODIFICATIONS

KAMTOUR reserves the right to:

• Modify or update this Disclaimer at any time, at its sole discretion
• Do so without prior notice

Continued use of the Platform constitutes acceptance of the updated Disclaimer.

No modification shall expand KAMTOUR’s obligations or liabilities beyond those expressly set forth in the Terms without affirmative user consent.
