1. Legal Nature and Jurisdiction

The Korea-America MedTour Association, Ltd. (KAMTOUR) is a private, independent, non-affiliated, non-governmental organization incorporated in the State of Delaware, USA. It operates as a private voluntary KAMTOUR Verified™, education, and professional standards organization. KAMTOUR is not a government agency, regulatory authority, or medical provider. All programs are voluntary and non-regulatory, intended for professional, informational, and educational purposes.

KAMTOUR Verified™ and Directory listings, or any other listings, initiatives, or programs are voluntary recognitions of quality under KAMTOUR’s standards and do not constitute governmental endorsement or guarantee of medical outcomes.

Inclusion in the KAMTOUR Directory reflects voluntary participation in the KAMTOUR Verified™ Program and does not constitute any commercial, referral, or patient brokerage relationship. Institutions that have submitted documentation for voluntary review — no KAMTOUR Verified™ is granted until full and final approval.

2. Scope of Activities and Korean Law Compliance

Under the Republic of Korea’s Act on Support for Overseas Expansion of Medical Services and Attraction of International Patients (2016), any organization that solicits or coordinates foreign patients must be registered as a Foreign Patient Attraction Business.

KAMTOUR does not solicit, arrange, or facilitate medical care, nor does it solicit, accept, or receive any fees or commissions of any sort from medical institutions, providers, or individual patients. Its activities are limited to KAMTOUR Verified™, education, and institutional collaboration.

KAMTOUR may accept advertising (see Advertising and Sponsorship Disclosure, below).

3. U.S. Federal Compliance (FTC and Advertising)

KAMTOUR fully complies with the U.S. Federal Trade Commission (FTC) Act and relevant advertising regulations. All testimonials and promotional materials include clear disclosures and do not make implied claims of medical outcomes.

No testimonial constitutes a warranty, endorsement, or representation of medical results. KAMTOUR provides no medical, legal, or professional advice and assumes no liability for reliance on any information presented.

4. KAMTOUR Verified™ and Accreditation Disclaimer

KAMTOUR Verified™ is a voluntary and private recognition based on ethical, operational, and professional standards. KAMTOUR Verified™ does not imply endorsement, guarantee of results, or satisfaction of governmental requirements. KAMTOUR Verified™ may be suspended, revoked, or withdrawn at KAMTOUR’s discretion.

5. Limitation of Liability

KAMTOUR, its officers, members, directors, shareholders, employees, affiliates, agents, vendors, contractors, volunteers, and representatives shall not be liable for any direct, indirect, incidental, or consequential damages arising from participation in, reliance on, or use of KAMTOUR materials, listings, or verifications.

All materials are provided “as is” and “as available,” without any warranties, express or implied. Users expressly waive any right to assert claims of negligence or implied duty against KAMTOUR, its officers, or affiliates.

6. Officer and Affiliate Indemnification

To the fullest extent permitted by law, KAMTOUR shall indemnify, defend, and hold harmless its officers, directors, shareholders, employees, contractors, affiliates, and authorized representatives from any and all claims, liabilities, damages, or expenses (including attorneys’ fees) arising from or related to participation in or reliance on KAMTOUR programs, KAMTOUR Verified™, or materials.

7. Forum Selection and Governing Law

This policy shall be governed by and construed under the laws of the State of Delaware, United States.

Any disputes arising in the Republic of Korea shall, to the extent permitted by public policy, be governed by Korean law with exclusive venue in the Seoul Central District Court.

All disputes arising under U.S. law shall be subject to the exclusive jurisdiction of Delaware state and federal courts, under Delaware laws, regardless of conflict or choice of laws.

8. Intellectual Property and Trademark Enforcement

The KAMTOUR name, logo, and Seal of KAMTOUR Verified™ are protected legal and/or common law trademarks. Unauthorized reproduction, display, or misuse is strictly prohibited and may result in legal action under applicable U.S. and Korean intellectual property laws.

KAMTOUR Verified™ organizations are authorized to display the seal only during the validity of KAMTOUR Verified™.

9. Data Privacy and Confidentiality

KAMTOUR maintains strong privacy protections and uses secure, password-protected systems for handling sensitive data. All personal or institutional information is processed according to U.S. and Korean privacy standards.

KAMTOUR does not sell or disclose data without consent, except where required by law.

10. Reservation of Rights

KAMTOUR reserves the right to amend, modify, edit, suspend, or terminate any program, KAMTOUR Verified™, standard, or publication at any time without notice. Participation in any program constitutes acceptance of this comprehensive disclaimer and all associated policies.

11. Non-Broker and Non-Facilitator Statement

KAMTOUR expressly affirms that it is not a broker, facilitator, or intermediary under the Republic of Korea’s Act on Support for Overseas Expansion of Medical Services and Attraction of International Patients (2016).

KAMTOUR does not engage in the solicitation, coordination, or arrangement of medical services, patient introductions, or travel facilitation. Its role is limited exclusively to KAMTOUR Verified™, education, research promotion, and institutional collaboration.

KAMTOUR does not solicit, arrange, coordinate, or receive compensation for any medical treatments, patient introductions, travel services, or clinical referrals, either directly or indirectly.

Its operations are strictly limited to voluntary KAMTOUR Verified™, professional education, research, event and conference organization, and publication of information promoting ethical standards in international healthcare collaboration.

12. Fee Structure Disclosure

KAMTOUR is a privately held U.S.-based company operating as an independent KAMTOUR Verified™, accreditation, and professional development organization serving healthcare institutions engaged in cross-border healthcare collaboration.

Participation in KAMTOUR’s programs is voluntary and subject to applicable evaluation and administrative fees. Fees are charged solely for KAMTOUR Verified™ review, verification, and program administration — they do not influence approval decisions.

KAMTOUR Verified™ cannot be purchased; approval is based exclusively on compliance with KAMTOUR’s internal standards and criteria.

13. Advertising and Sponsorship Disclosure

KAMTOUR accepts paid advertising, sponsorships, and promotional placements from qualified organizations and institutions.

Such advertising and sponsorships are intended to support KAMTOUR’s educational and outreach initiatives and do not influence KAMTOUR Verified™ eligibility, decisions, or evaluations.

Acceptance of advertising or sponsorship does not constitute endorsement or approval by KAMTOUR. Advertisers and sponsors are solely responsible for the accuracy and legality of their content and claims.

All advertisements and sponsorships are clearly identified in compliance with U.S. FTC and Korean fair advertising regulations.

14. Plain-Language Summary

KAMTOUR is a private, non-governmental, U.S.-based organization. KAMTOUR Verified™, membership, and listings are voluntary and do not imply endorsement, government recognition, or guarantees.

All materials are educational and informational. KAMTOUR and its officers assume no liability for actions or representations of KAMTOUR Verified™ or listed entities.

In case of translation discrepancies, the English version shall prevail.

15. Electronic Agreement Clause

Use of KAMTOUR’s website, directory, or participation in any KAMTOUR Verified™, program, or event constitutes acceptance of this Compliance and Disclaimer Policy as a legally binding agreement.
