1. ROLE OF THIS DISCLAIMER

This Master Disclaimer is incorporated into and forms a legally binding part of the KAMTOUR Terms of Use (“Terms”).

By accessing or using the Korea–America MedTour Association, Ltd. (“KAMTOUR”) website, platform, directory, or any related services (collectively, the “Platform”), you acknowledge, agree to, and are legally bound by this Disclaimer.

In the event of any irreconcilable conflict between this Disclaimer and the Terms, the Terms shall control.

2. NATURE OF KAMTOUR (NO INTERMEDIATION; NO PATIENT-FACING SERVICES)

KAMTOUR is a private, U.S.-based, non-governmental platform that supports bilateral institutional engagement between healthcare organizations in the United States and Korea. KAMTOUR works directly with hospitals, academic medical centers, clinics, research organizations, and supporting healthcare entities.

KAMTOUR does not imply any affiliation with, endorsement by, or association with any government authority.

KAMTOUR is not:

  • A governmental authority or regulatory body;
  • A trade association;
  • An accreditation or certification organization;
  • An endorsement, rating, or recommendation entity; or
  • A patient-facing organization.

KAMTOUR does not provide any guarantee, assurance, or representation regarding the quality, safety, legality, or outcomes of any services, providers, or third parties, whether public or private.

KAMTOUR’s Services

KAMTOUR’s services are provided exclusively to institutions and organizations and consist of three connected functions:

  • Institutional advisory and consulting — KAMTOUR’s primary service, provided directly to institutions navigating cross-border U.S.–Korea engagement;
  • Platform infrastructure (KAMTOUR Verified™) — administration of a standardized institutional identity and representation framework; and
  • Symposia and institutional convenings — coordination of structured bilateral forums, meetings, delegations, and programming.

Limits on KAMTOUR’s Role

KAMTOUR:

  • Does not provide medical, legal, financial, or professional advice;
  • Does not provide patient-facing services;
  • Does not refer, recruit, place, or coordinate patients;
  • Does not coordinate medical care;
  • Does not act as an agent, broker, intermediary, or representative of any institution, including in institutional transactions, negotiations, communications, or agreements; and
  • Does not establish provider–patient or clinician–patient relationships.

All institutional relationships, transactions, and agreements occur directly between participating organizations.

Use of the Platform does not create any agency, fiduciary, or advisory relationship except as expressly set forth in a written consulting engagement signed by an authorized officer of KAMTOUR. Where KAMTOUR provides institutional advisory and consulting services to a client, the scope, terms, and obligations of that engagement are governed by a separate written agreement and do not modify these Terms or this Disclaimer.

KAMTOUR does not assume, and expressly disclaims, any duty of care, professional standard, or obligation toward any user, patient, client, or third party except as expressly set forth in a written agreement signed by an authorized officer of KAMTOUR.

No provider–patient, advisor–client, or similar professional relationship is created through use of the Platform.

3. THIRD-PARTY CONTENT AND INFORMATION

All listings, profiles, materials, and content on the Platform, including listings within the KAMTOUR Institutional Network:

  • Are provided by third parties;
  • May be incomplete, outdated, or inaccurate; and
  • May change at any time without notice.

KAMTOUR:

  • Has no obligation to verify third-party information beyond the limited scope of the KAMTOUR Verified™ review;
  • Does not guarantee accuracy, completeness, or reliability;
  • Assumes no responsibility or liability for any third-party content;
  • May rely entirely on third-party submissions and undertakes no independent verification or ongoing monitoring; and
  • Has no obligation to update, correct, or maintain any content.

KAMTOUR is an interactive computer service provider within the meaning of 47 U.S.C. §230 and does not create or develop third-party content.

4. KAMTOUR VERIFIED™ DESIGNATION

KAMTOUR Verified™ is the institutional identity and representation review program operated by KAMTOUR. It is governed by the KAMTOUR Verified™ Standards Manual and the KAMTOUR Verified™ Application and Fee Schedule, each of which is incorporated by reference into the Terms.

KAMTOUR Verified™:

  • Is a limited, proprietary designation reflecting a structured review of institutional identity and representation based on submitted materials and publicly available information;
  • Is limited to confirmation of institutional authenticity, active operational status, and consistency between submitted and public-facing information;
  • Does not evaluate clinical quality, safety, outcomes, treatment protocols, patient safety systems, provider credentials, malpractice history, or regulatory compliance beyond submitted materials;
  • Does not constitute accreditation, certification, ranking, licensing, clinical endorsement, referral recommendation, or governmental approval;
  • Does not constitute medical or clinical advice or recommendation;
  • Does not involve independent investigation or ongoing monitoring of verified organizations except as expressly agreed in writing; and
  • Is intended for institutional use within the bilateral U.S.–Korea engagement environment and is not a consumer-facing rating, recommendation, or referral system.

Verified organizations may elect optional visibility tiers (Gold and Platinum) under the Standards Manual and Application and Fee Schedule. These tiers relate solely to visibility and presentation within the KAMTOUR Institutional Network and do not affect verification determinations or the standards applied to participating institutions.

Any interpretation of KAMTOUR Verified™ inconsistent with the Standards Manual, the Terms, or this Section 4 is expressly disclaimed.

5. NO RELIANCE

You expressly agree that:

  • You will not rely solely on the Platform, on any KAMTOUR designation, or on inclusion in the KAMTOUR Institutional Network; and
  • You will conduct your own independent due diligence and institutional review.

This includes, without limitation:

  • Verifying credentials, licensure, and qualifications;
  • Evaluating risks and appropriateness of services and counterparts;
  • Conducting independent institutional review of potential partners and counterparts; and
  • Seeking independent professional advice.

Any reliance on the Platform or any KAMTOUR designation is solely at your own risk and is deemed unreasonable as a matter of law.

6. USER RESPONSIBILITY

You are solely responsible for all decisions, including but not limited to:

  • Healthcare and clinical decisions;
  • Institutional decisions, including selection of partners, counterparts, and providers;
  • Travel or cross-border arrangements;
  • Financial commitments; and
  • Selection of services.

KAMTOUR has no involvement in and no responsibility for such decisions or outcomes.

KAMTOUR does not participate in, influence, or review any user decision-making process, except to the extent expressly set forth in a written consulting engagement signed by an authorized officer of KAMTOUR.

7. ADVERTISING, SPONSORED CONTENT, AND OPTIONAL VISIBILITY TIERS

The Platform may include advertising, sponsored content, and paid promotional placements, including enhanced visibility, featured placement, or upgraded listing status (e.g., Gold or Platinum). All such content is clearly identified.

Such placements are based on promotional arrangements and do not reflect quality, ranking, endorsement, or recommendation by KAMTOUR.

Advertising, sponsorship, paid promotional arrangements, optional visibility tier participation, and engagement of KAMTOUR’s institutional advisory and consulting services do not influence KAMTOUR Verified™ eligibility, review processes, criteria, determinations, or outcomes. Verification status is determined by uniform criteria applied consistently to all applicants.

Any fees associated with KAMTOUR Verified™ applications are administrative fees for review and processing only and are not payments for advertising, sponsorship, endorsement, or preferential treatment.

Advertisers, sponsors, and listed entities are solely responsible for the accuracy of their claims and for compliance with applicable laws and regulations. Advertising, sponsored content, or placements do not constitute endorsement.

8. NO WARRANTIES

All Platform content and materials are provided “AS IS” and “AS AVAILABLE.”

KAMTOUR expressly disclaims all warranties, including:

  • Accuracy;
  • Completeness;
  • Reliability;
  • Fitness for a particular purpose; and
  • Non-infringement.

KAMTOUR does not warrant that the Platform will be uninterrupted, error-free, secure, or free from harmful components.

KAMTOUR makes no representations or warranties of any kind, whether express or implied.

9. LIMITATION OF LIABILITY (STRUCTURALLY ALIGNED WITH TERMS)

To the maximum extent permitted by law, KAMTOUR shall have no liability whatsoever, whether in contract, tort, negligence, strict liability, or otherwise, for:

  • Any third-party actions, omissions, or misconduct;
  • Any healthcare, business, travel, or service outcomes;
  • Any institutional engagement, partnership, collaboration, or transaction outcomes;
  • Any reliance on Platform content or designations;
  • Any indirect, incidental, consequential, special, or punitive damages; or
  • Any claims arising from negligence, reliance, or alleged failure to act.

This limitation applies even if such damages are foreseeable or KAMTOUR has been advised of the possibility of such damages.

Your sole remedy is to discontinue use of the Platform. Liability is further limited as set forth in the Terms of Use, including applicable liability caps.

10. THIRD-PARTY SERVICES AND LINKS

The Platform may include links to external services or websites, including external links to institutional websites of organizations listed in the KAMTOUR Institutional Network.

KAMTOUR:

  • Does not control or operate third-party services;
  • Does not endorse or assume responsibility for them; and
  • Has no liability arising from third-party interactions.

All engagement with third parties is at your own risk.

KAMTOUR does not monitor, supervise, or control third-party services or interactions. All interactions with external institutions occur independently and are subject to their respective terms and policies.

11. UPDATES AND MODIFICATIONS

KAMTOUR reserves the right to:

  • Modify or update this Disclaimer at any time, at its sole discretion; and
  • Do so without prior notice.

Continued use of the Platform constitutes acceptance of the updated Disclaimer.

No modification shall expand KAMTOUR’s obligations or liabilities beyond those expressly set forth in the Terms without affirmative user consent.

12. PLAIN-LANGUAGE SUMMARY

  • KAMTOUR is a private, U.S.-based platform supporting bilateral institutional engagement between U.S. and Korean healthcare organizations;
  • KAMTOUR provides institutional advisory and consulting services, the KAMTOUR Verified™ framework, and symposia and institutional convenings—all directly to institutions;
  • KAMTOUR is not a regulator, accreditor, certification body, trade association, or patient-facing organization;
  • KAMTOUR does not refer, recruit, place, or coordinate patients, and does not act as an intermediary, broker, or representative in institutional transactions;
  • KAMTOUR Verified™ is not endorsement, accreditation, certification, ranking, or licensing;
  • All decisions are yours; and
  • You must verify everything independently.
